Anything is possible. A judge may order her out of the Texas rental house, but she won't be ordered to move back to Georgia. And it's very difficult to get a judge to take a two year-old away from his mother. You need a lawyer. Good luck.

Despite what you emotionally feel, and justifiably so, it would be a bad idea to kick her out. Rely on the court to act on your request to have exclusive use and possession of the residence, rather than attempting to usurp the authority of the court. Such is always a better idea. I can see you today if you want to act quicker and are in the Houston area.

How do I obtain a special warranty deed to release me from a mortgage, without refinancing the home.

A special warranty deed would not remove you from the mortgage.  When you got divorced, your divorce attorney should have had your ex-wife sign a deed of trust to secure assumption.  The deed of trust would allow you to foreclose on the home if and when your ex-wife failed/fails to timely make a mortgage payment.When a divorce decree requires one party to sell or refinance a home within a certain period of time, you can petition to enforce the decree by having the court appoint a receiver to sell the property.  Often, in these situations, the receiver is a real estate agent.
