Should have been automatic once the Clerk of Court learned of the marriage. He needs to file motion, any payment back to him is up to your Judge.

If he was not officially divorced when you two got married, then your marriage is null and void. That is called bigamy. Either he or you can file an action to annul your marriage and it would be granted. If you want to fix it, you will need to get legally re-married now that he is divorced.

In order to end your marriage, you will need to file a divorce.  If you have a child by another man, and you do not want your current husband to have any parental rights to this child, then, again, you should file a divorce.  If you want the biological father involved , then that can be addressed during the divorce.  Stu Shafer
