Do I keep my house I purchased before the marriage?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
If the property was purchased prior to marriage and you did not add her name to the deed during the marriage, then then presumption is that the home is your sole and separate property. She might be entitled to some kind of reimbursement for payments made toward the mortgage during the marriage, but that is more complicated than what I can describe here. I recommend you consult with an attorney to discuss this in greater detail.

Can we have a mutual divorce without help from an attorney?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
Yes, it is possible, a single attorney could be a mediator/arbitrator and only the scribe, but the better way is to have one lawyer hired by one of the parties who does the work and represents one of the parties only, with the final agreement taken to the other party's attorney, hired for an hour or two, to review and explain the proposed judgment to their client.

What are my rights as a woman and mother, that has been cohabiting for 18 years?

Answered by attorney Anita Alice Webster (Unclaimed Profile)
Divorce lawyer at Law Offices of Webster & Associates
It all depends on the facts of your case. For example, how were titles held, what contributions you made towards the purchase of items, or if you held yourselves out as married and filed joint returns, etc. As a mother, you and your ex would need to agree on custody of the minor children or the court would have to decide and award child support accordingly. You are best off consulting with an attorney to find out your rights. This response is intended to provide general information only and is not a substitute for speaking to an attorney. This response does not create an attorney client relationship between the Anita Webster, Esq. or Webster & Associates and the readers.
