What age my kids could talk to the judge?

Cathy Rose Cook
Answered by attorney Cathy Rose Cook (Unclaimed Profile)
Divorce lawyer at Cathy R. Cook, Attorney at Law
A party may request the court speak with children to determine their wishes regarding parenting time. When such a request is made, the other side has a right to ask for a guardian ad litem to investigate the situation and determine what he or she believes is in the best interest of the children, including speaking with the judge. If the children do speak with the judge, he or she has to decide if they are mature enough to provide input in the matter before asking their opinions.

That is an extremely complicated question. I suggest you consult with a family law attorney as soon as possible. There are a number of factors considered by the Court in making a determination of spousal support.

As you are aware, spousal support is based on the parties' incomes. The pension etcetera will change your spouses income level. You need to file a Request for Order to terminate or in the alternative modify spousal support.
