You could, but your affidavit saying that the 30 days had expired would not be valid, would it? Better to have the documentation prepared to be filed on the first day after the period has expired.

This child is presumably both your child. Thus the child's last name is an issue that can be addressed in the parenting plan, which has to be filed as part of the divorce. The fact that he is a convicted felon does not go to whether he has the rights of a father, but how much he gets to see the child in the child's best interest. It certainly has no bearing on the child's name. Depending on the nature of his convictions, he will get supervised or unsupervised time. The issue is not joint custody (custody per se does not exist in Washington divorces) but how much time the child spends with each parent and whether there is joint decision making authority.

Well.... Compensation for what? In Nevada, property rights continue to accrue until divorce, regardless of separation. Up to 4 years back child support is possible - but that clock is ticking, and you may have only two years to claim at this point, depending on the facts - which still may be a lot better than nothing. And you have a presumptive entitlement to half the military retirement benefits earned during the time the marriage overlapped military service - which is probably worth more than everything else put together. What you need most is a full consultation with qualified family law counsel.
