If the mortgage on the house is paid from earnings (yours or hers) she will have a claim against the house. You need a prenuptial agreement outlining what belongs to whom, how you will pay for things during the marriage, what belongs to both of you and what happens if you get divorced. Without that, all property acquired or paid on during the marriage is community property including all your earnings. Having only one name on an account doesn't make it separate property.

Generally speaking property purchased during a marriage is community property. If both of your names are on the deed to the property then the court will order it to be divided. You should consult with experienced family law counsel to understand the dissolution procedures, and your rights and obligations.

The court will look at the total circumstances concerning the purchase of the condo. If it is in your name and purchased before the marriage, there is a presumption that it is your separate property. But the court will look at the equity in his down payment. He is wrong about his priority in taking the home. You will need an attorney to handle this issue.
