If we divorce now, can I still get my green card? How?

If you divorce before then, there will be no marriage to support an approval. If it is dangerous to wait, you may want to consider a separate petition under the Violence Against Women Act (VAWA).

have the court place the matter on the trial docket, for trial and a decision, or for the entry of a judgment. At this point, get an attorney to move this along.

Is my spouse entitle to any of the retirement plan?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
There is a possibility that she may be entitled to one-half of the increase in value, starting with the value of the plan on the date you were married to her until the date of the divorce. But, since no community property was used or community time was used to increase the value, it is more likely that it will be treated as your sole and separate property.
