Adultery generally needs a third party to substantiate the facts. Many times a private investigator is necessary. Regardless, under the new No Fault grounds law, if your ex- moves for a divorce based on No Fault and you are asking for a divorce based on Adultery, generally, the court will grant a No Fault divorce.  The importance of grounds may be relevant if there is going to be a custody dispute.

This is complicated and depends on many factors. Do you still have equity in the house? Do you earn more money than he does and would you be paying him spousal support in a divorce? Who's been paying the mortgage and taxes since you left? Ideally you should get your name off the deed and loan and if he wants to stay in the house he should find a new co-signer for the modification. But if you have equity you need to be compensated for your share. Much more information is needed in order to answer your questions.

Your wife is entitled to division (usually, but not always, 50-50) and a share of that portion of your pension that was accrued during the marriage, and whether either or both of you file bankruptcy has no effect on your wife's rights to a portion of your pension in divorce. Now if your pension is consumed by the bankruptcy, then your wife would not be entitled to any portion of your pension because the pension is no longer your property but that of the bankruptcy estate and will be used to pay off creditors and the bankruptcy trustee.
