How long will a retail fraud stay on your record?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Were you charged as a juvenile or as an adult? If it was as a juvenile, then your record is sealed from the public. If as an adult, were you given a diversion program option or HYTA status which would keep the charge off of your public record? If not, all crimes that enter on your record will stay there forever unless sealed or expunged. If eligible for an expungement, you will have to wait at least five years before applying.

Depending on what the conviction was for and what your sentence was, you may be eligible to seek a dismissal under Penal Code section 1203.4. As long as you weren't sentenced to state prison, you can apply to have it dismissed. It's worth discussing the particulars face to face with a local criminal defense attorney to see whata options are available to you.

How many times can they postpone my brother's trial?

Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
Generally there is a rule that a trial must be commenced within 180 days if the accused is in jail. However, if is possible that has been waived. You should be seeking this information from your brother's attorney.
