I would fight it in court then. Unless the prosecutor can track down whoever called in the alleged violation, you've got an excellent chance of winning. Beware, though, cops have a hard time remembering every ticket they write, and the chances of him saying on the stand that he did not see the violation are slim.

This is minor. Call the Sacramento County Bar Association Lawyer Referral Service. You should be able to get a free consultation. Call the DA in the appropriate office saying you want all the "discovery," all the evidence against you. After you read that get your free consultation. Maybe the case will be dismissed outright. If you do diversion, not very burdensome, the case is dismissed. You can talk to the DMV about license suspension. But all info should be online. Talk with the DA, if necessary, but don't admit outright you were smoking the joint.

Your relative has statutory rights to a speedy preliminary hearing and trial. They can only continue the case with his agreement and consent. This may be a tactical decision that he and his attorney have made - there's no way to guess as to what the evidence is or the reason for the delays. Only the attorney that actually represent your family member can answer.
