What happens with a Will when one party dies?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
We simply cannot tell you much without seeing the actual will. If a beneficiary in the will dies before the decedent does, the gift to the beneficiary is usually given to that beneficiary's children. But that is only one form of distribution known as per stirpes. A per capita distribution is different. We have to see the will to be able to say which it was.

If you are arrested you will be taken to jail. You will probably need to post bond. There will be criminal charges against you and you should get an attorney.

If the person is in jail 90 days, or a bond must be set. If the person is out of jail, four years, or the charges must be dismissed.
