Is there a way to change my assault conviction?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
Even if the State does not allege that the assault involved a family member, they can later prove it up if you were subsequently charged (and enhance the case to a felony.) The "family" part of the charge is generally not even discussed in negotiations - either it involves a family member or it does not. If you did not hit the person, set the case for trial! You should not plead guilty to something that you did not do and risk a future felony charge.

Can an officer tell me I’m free and innocent and then three months later write me a ticket?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Yes, they have a 2 year statute of limitations. So technically, the officer can do that. But sounds like you have a good defense. Hire an aggressive criminal attorney to fight it.

Should I cancel a polygraph test?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
It depends on who is administering the test and what purpose you are having one taken for. Have there been any agreements about the admissibility of the results? I would not take one until consulting with an attorney first. There can sometimes be strategic reasons for taking a polygraph, but not usually.
