What are the possible penalties after my friend is being charged with larceny of a credit card and 6 counts of unlawful use under $250?

Answered by attorney Kristi Noelle Gladden (Unclaimed Profile)
Criminal Law lawyer at Gladden-Flenniken & Associates, LLC
Realistically, it depends on in which county your friend is charged. Legally, he/she could face up to 10 years on each count. But, practically speaking, it depends on whether you have a more liberal judge or a strict judge. Your friend's attorney will be negotiating with an Assistant District Attorney, not the Judge, but all ADA's base their recommendations on what the Judge normally will accept for a plea.

If I have been charged with felony larceny with no prior convictions, can I plea to a lesser charge?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
You should retain a criminal defense attorney in your local area. Not only can your attorney provide a defense to the charges, he/she would know what arguments should be made to reduce the charges and minimize any future consequences.

How long do they have to take me to trial before the case is dismissed according to the speedy trial law?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
You are out of custody. Your arraignment was April 2, 2014, so speedy trial starts running on that date so 90 days from April 2nd. However, that still does not mean that your case will result in a dismissal. There are lots of other factors that need to be considered.
