Anyone who had access to the weapon could be charged with possession of it - you do not have to own a weapon to be in possession of it.

This would apply to the State of Colorado. You do not have to help police investigate and build a case against you. The police cannot make you talk to them. Under the Fourth Amendment of the US Constitution, you have a right to remain silent, use it.

The charges can always be refiled if it was dismissed without prejudice. If it is dismissed with prejudice then yes it can be refiled.
