If I have a third degree felony that I was convicted of over 15 years ago, breaking and entering, am I able to own a firearm of any kind?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
It depends on what type of felony you were convicted of. If it was what was a non specified felony your rights would be automatically restored after 3 years of successfully completing your sentence. If it was a specified felony, you would have to wait 5 years after successfully completing your sentence and petition the gun board in your county. Consult with a firearm attorney in your area for a review of your case and how to proceed.

How do we prove that he didn't strangle him and all he did was restrain him?

Answered by attorney Patrick Owen Earl
Criminal Law lawyer at Patrick O. Earl
The accused person in this situation needs to hire an experienced criminal defense attorney immediately. It will be very important to get someone on this to get the statements from potential witnesses and gather all the information about the case so that it can be explained well to the State prosecutor. If this is a case from WA state, the Eastern Side of WA state.

My daughters boyfriend is on parole

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Criminal Law lawyer at Miller & Harrison, LLC
I am not clear on your question, as to whether it relates to the "punch in the eye" she took or the fact he left her place. It is her boyfriends responsibility to let parole know where he lives. As to your daughter as a victim of his punch, it is up to her whether to report it and how much to cooperate with the prosecution of his case. She can be forced to attend court and testify (via a subpoena) if he is charged, but she has to be served properly with a subpoena for that requirement to come into play.
