If you are so afraid, say goodbye to your family and take the prison plea for the burglary. You don't need any attorney, because all an attorney is going to tell you is to fight the case, and offer testimony against the person, and claim coercion. None of which is going to protect your family from thie person that has many associates, who you are soo afraid of. You are going to prison and don't need an attorney if you are not going to fight the deadly person. If you are going to fight, then you will have to explain why you did not fight before you committed the burglary.

Anybody can be charged as long as the statute of limitations have not yet expired on the crime they are being charged with. He would only have to be read his Miranda rights if he was in police custody and was being interrogated or asked potentially incriminating questions. It's determined on a case-by-case basis. Have an experienced criminal attorney review the police reports and case file and make sure your son has good representation. If you have any court dates coming up, the court should notify you.

Can I be charged with public intoxication after I was accused of theft?

In Mississippi, you can be arrested inside of a public establishment and be charged (and convicted) of public intoxication. It does seem strange that they can arrest you inside of a bar, a place where alcohol is the main attraction, and charge you with public intoxication. Generally when someone is arrested on this charge (and particularly when inside an establishment that serves alcohol), it is more because of their conduct and attitude rather than their state of inebriation. In your case here it appears as though the officer wanted to save face as he/she found out that they couldn't get you for stealing the tip jar so the only thing he had was a bogus charge. I say fight it.
