Can Texas DPS wait as long as they want to suspend your license after a conviction or do they have a time frame?

Answered by attorney Robert W. Eutsler (Unclaimed Profile)
Criminal Law lawyer at Eutsler Law Firm
Sounds like the administrative suspension proceeding was delayed about a year for whatever reason. The judge gave you good advice. Talk to a competent driver's license lawyer right away. Do not represent yourself. Depending on when your first DWI was, you may already be suspended by the DWI judge (not the administrative judge, yet) due to the second DWI plea. Check with DPS or call us to research the current status of your license.

If you are already in custody, can a warrant be issued for the reason you’re in custody?

It can if its issued by another court for a different matter. The purpose of the warrant is to prevent the statute of limitations from running so you can be prosecuted by the other jurisdiction once the current case is completed.

What does it mean if they tell my husband that he will only be in jail for a percentage of the time?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Depending on his crime and the time, he may be eligible for good time credit or the jails are overcrowded. You need to consult a post-conviction legal specialist and see if they can advise you further.
