What will happen to my minor son if he gets pulled over for speeding and drugs?

John E. DeVito
Answered by attorney John E. DeVito (Unclaimed Profile)
Criminal Law lawyer at John DeVito
In Massachusetts a 17 year old is considered an adult in criminal court. A criminal record will be created if he is charged with a crime. If he had less than an ounce of marijuana, no crime was committed. He can be fined civilly $100.00. Speeding is also a civil infraction, the fine is dictated by the mph over the speed limit. Drug Paraphernalia is a misdemeanor offense punishable with jail up to 2 years and/or a fine of $500 to $5000. If you son was not arrested an attorney may be able to stop criminal process. If he was arrested, he needs an attorney to challenge the case and avoid a conviction. Be advised,a drug case conviction may prevent your son from obtaining federal financial aid in college. What can I do if the police searched my house without a search warrant?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
you need a lawyer or Public Defender - tell the police, I want a lawyer and nothing else if the warrant was not approved until after raid, then entire search is bad - i have won search warrant cases - if the CI was never in the house, it would be tough for anyone to rely on his/her word about what happens there all jail calls are recorded. I would be happy to discuss representation.

What options do I have or will I be forced to serve jail time due to not paying my court fees?

Cynthia Russell Henley

If you had 9 months of probation, then it was not a class c. And, you didn't just fail to pay fees - you didn't do your community service AND you are an absconder - you quit reporting before your probation terminated. What could happen demands on the underlying charge; how you otherwise did on probation; whether you turn yourself in or get arrested; you explanation for not doing the community service - and there is not many decent ones; and whether you pay the money owed up front. You DO need a lawyer who knows the court and can handle the case BEFORE you get arrested.
