Can police search my vehicle without a warrant?

Answered by attorney Steven Fairlie
Criminal Law lawyer at Fairlie & Lippy, P.C.
It would depend on what they had probable cause to believe was in your car. If they have probable cause to believe that something which is readily destroyable, and is evidence of the crime, is in your car, then they can likely search without a warrant under the exigent circumstances exception to the warrant requirement. It would be safer for them to get the warrant but most Pennsylvania Judges approve of car searches without a warrant when exigent circumstances exist.

How can I stop someone from accusing my daughter of breaking and entering?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
There is nothing that you can do to stop it. If the police investigate, she will need a lawyer BEFORE she talks with them so that she is not harassed or pushed. If she makes a statement, then it needs to be thorough and complete or anything she leaves out and later remembers will be claimed to be untrue. Burglary of a habitation is a second degree felony which carries from 5 to 99 years or life for an adult. (It is different for juveniles but still very serious. It could result in a stint in Texas Youth Commission.)

Can you be charge with evading flight from officer when I was a passenger in the car?

Answered by attorney Michael L. Aaronson
Criminal Law lawyer at Aaronson Law Firm
It is my belief that as a passenger you cannot be charged. It's true that it's a felony if committed in a vehicle and you should contact a lawyer to discuss this.
