Why are the police holding someone when the drug test came back negative?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
They are allowed to hold him until either he bonds out or his case goes to court. There is no guarantee it will get dismissed. They may charge him with reckless driving or some other drug. Best bet is to get him bonded out and fight it. Unfortunately, if you can't afford it, he'll probably plead guilty to just get out. It's a sad comment on our judiciary system.

How do I nullify my contract (license) with the DMV?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
You are undertaking a difficult and expensive journey, and as much as you believe you are correct the authorities will disagree and fight you. Please also consider that almost every automobile insurance requires covered drivers be "licensed" and will deny coverage to those who are not (and that private contractual provision will be upheld by the law). I would find another way to express your rightful and clearly strong disagreement with the present evolution of the United States society and its apparent future direction.

My son is on probation in one county and has a violation already and recently got a second one . What are chances of revokation?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
He has an excellent chance of being filed on for revocation. The first condition of probation is that you commit no other crime while on probation. It may be possible to get the probations continued if there is a reasonable explanation for the new offense of drug or other difficulties that need to be addressed. If not, the sentence may be reduced by good work by his attorney.
