Can you secretly record conversations between you and a friend?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)
Criminal Law lawyer at Catchick Law, P.C.
In Michigan, you can record a call for which you are a "first party" participant (for example, you could not record a conversation that was between your husband and his alleged mistress). However, if the caller on the other end of the phone line is in another State or Country, that State's or Country's laws may apply, so please proceed cautiously.

What punishment am I looking at if I was caught stealing?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Did you steal from a person or from a store? That will make a big difference. If it is shoplifting, the chances of going to jail are probably slim. Probably at worst you face probation. Many jurisdictions offer diversion programs and other sentencing options for first time offenders that would keep the matter off your public record. Consult with an experienced criminal attorney in your area to discuss your options and likely outcomes.

Should I plead not guilty for running through flashing red light?

Answered by attorney Andrea Rogers (Unclaimed Profile)
Criminal Law lawyer at The Rogers Law Firm
I suggest that you hire a traffic law attorney to represent you. Your attorney will negotiate a plea bargain with the court to get your ticket amended to a non-moving, no-point infraction, which means no points will be added to your driving record and your insurance company will never know you received the ticket. You will have to pay a fine and court costs, but you won't have to appear in court. If you just go to court on your own without a lawyer and plead guilty, then the judge will sentence you and the conviction will go on your driving record and your insurance company will be able to see that you received the traffic conviction. If you plead not guilty, the judge will set the case for trial and you will have to either hire an attorney to represent you or represent yourself.
