How do I get a state pardon for a misdeamanor?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The answer depends on the sentence. I doubt you mean you want a pardon. That comes from the governor and requires extensive work on the part of your attorney, great expense and is difficult to get. You probably mean either an expunction or a non-disclosure order. If you received a deferred adjudication and did it is successfully completed, a non-disclosure order will probably accomplish what you want to avoid employers seeing the record. If you received a straight probation you may be able to get a section 20 discharge to set aside the conviction. If the case was dismissed, you may be eligible for an expunction which results in the removal of all records from your criminal history. If you were convicted or pled and received a sentence, the only answer is a pardon and, as I wrote above, it is a complicated, expensive process and is rarely done for a misdemeanor because there is no assurance that the attempt will be successful.

Can I expunge after my probition and if yes how long after?

default-avatar
Answered by attorney John Arthur Nechman (Unclaimed Profile)
Criminal Law lawyer at Katine & Nechman, LLP
In Texas, you cannot get a case expunged if there was a deferred adjudication community supervision (except for Class C misdemeanors). You may be eligible for filing a petition for non-disclosure, which will seal the case from public view, but that depends on the type of case, as does the waiting period once the deferred adjudication is complete.
