How long can a jail hold an inmate in jail with out seeing a judge

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Criminal Law lawyer at Miller & Harrison, LLC
If he is being held just on the warrant - he should see a judge within at least 72 hours.  Is it possible the case he has the warrant for had some 'suspended' jail time - which he is now serving?  A lawyer shoudl be able to help straighten this out, so hire one in the county where his cases are to help out.

If you are on the run for 6 years will they drop your case?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
Not necessarily if the case has been filed, then the statute of limitations is satisfied and will not protect him speedy trial does not protect him BUT I have seen cases with 5 year warrants - once the 5 years passes, the warrant ends and the case is closed no one continues to look, so effectively, the case is dismissed a good lawyer can help figure this one out BTW - the bigger the case, the less likely it is to get lost.

Yes, but as a general proposition records relative to cases that are dismissed should be expunged from your record as opposed to sealed.
