Can I leave the state without permission?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You will have a warrant for your arrest. I doubt the State will come after you, but if you ever come back and get pulled over then they will arrest you. Maybe they would put it on a national database so that if you are pulled over in another State they could arrest you and then transfer you back to Texas, but it's unlikely since DWI is not that bad of a crime. Now murder is another story. But DWI is pretty small potatoes for the State of Texas.

Can I stay out of jail with unlawfully carrying gun in car?

default-avatar
Answered by attorney Lucio Antonio Montes (Unclaimed Profile)
Criminal Law lawyer at The Montes Law Firm
It was unlawful to have a firearm in your vehicle because you were committing a class B misdemeanor with the possession of marijuana. You should speak to a local criminal defense attorney that can challenge the legality of the stop. Many more details are needed to fully answer your questions, which is precisely why you should consult with a local criminal defense attorney. Most criminal defense attorneys afferent free consultations. Good luck.

Can I get several misdemeanors expunged from my record?

default-avatar
Answered by attorney Dennis Julian Roberts (Unclaimed Profile)
Criminal Law lawyer at Dennis Roberts A Professional Corporation
You cannot get a DUI expunged. Look at Penal Code Section 1203.4 (Google California Penal Code). Basically an expungement does not do a damn thing. A prospective employer can ask you to sign a waiver letting him view your record. All the record will do is list all your convictions and, under that, "relief granted under P. C. 1203.4" and you still can't use it for your DUIs. Not worth it.
