It depends on the strength of the case and his criminal record. At a minimum he is facing 1 to 9 years in jail although probation is possible if he is not a second felony offender. I suggest he retain a good criminal defense lawyer. I am a former federal and State prosecutor and now handle criminal defense. He can contact me if he is interested in retaining a lawyer.

Without your being present. Did you allow her to go to the store without you? YES. Did you think she was old enough to supervise herself when she was at a retail establishment? YES. Then the police and law enforcement can use the same judgement to question and search her, because the first question that was asked in the loss prevention office was: IS your mother or father present in the store? No, because they think you are old enough to supervise yourself, then you are old enough to be questioned.

While the public defenders office has some very competent attorneys, private criminal defense attorneys devote a lot of time to each and every case they handle. It is your choice to take the court appointed one or to hire a private one. Most criminal defense attorneys worked for either the public defender or the state attorney when starting out. Each case is different and it would not hurt to set up a few free consultations with private attorneys in your area.
