Currently in our district, the Northern District of Georgia, you are only allowed to "strip" second mortgages in Chapter 13 cases not Chapter 7. The ability to remove second mortgages also depends on the equity in your home and if the second mortgage is completely underwater. I would suggest contacting a local bankruptcy attorney in your area to see what options are available in your district.

First, Florida is not a Deed of trust state it is a mortgage state, so I am wondering if you are in Fl or if the property is even in Fl. In any event, a chapter 7 or a 13 can be your salvation in you can "surrender" secured property (like your house) and the loan balance "discharged". A Chapter 7or 13 can also eliminate a "deficiency" from the sale of a secured asset.

If there is a deficiency for an automobile this can be discharged in bankruptcy. If this is the only debt you may want to make an agreement rather than file bankruptcy.
