How do you know if you should file for bankruptcy?

Answered by attorney Christian Frederick Paul (Unclaimed Profile)

The best way to find out if bankruptcy is right for you is to make an appointment with a local bankruptcy attorney, take with you whatever documents he or she requests, and listen to the advice. Many attorneys give a free consultation, and what you find out could be very helpful to you. The bankruptcy will show on your credit report for seven years, but your credit score might actually improve once the debts are listed as zero, and you probably will receive credit card applications without asking for them. You can ask the attorney specific questions about these things when you visit him or her. Good luck.

Under the Lady Bird Deed, can they seize the money my sister who filed bankruptcy owes her creditors?

I would have to review the documentation for a definitive action but generally, and as a matter of principal, creditors can only take what your sister would have been entitled to. The devil will be in the details and should be addressed between YOUR attorney and her bankruptcy attorney.

Can a collection agency take money in my checking account if it was deposited from my social security or pension?

Possibly, and generally yes. When the money is in your account it is simply your money and subject to attachment. Under some circumstances it can be protected.
