Would filing for bankruptcy take care of my debt to the irs

Barry J. Roy
Answered by attorney Barry J. Roy (Unclaimed Profile)
Bankruptcy lawyer at Rabinowitz, Lubetkin & Tully, L.L.C.
The short answer is no.  Generally speaking, taxes owed to the IRS are non-dischargeable in a bankruptcy.  That being said, in some instances (old income taxes), taxes may be discharged.  I would recommend obtaining a transcript from the IRS that details the taxes due and owing and then seeing an experienced bankruptcy lawyer.

Will filing bankruptcy have an effect on my current student loans?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
Bankruptcy should not affect the loans you have received or will receive. Understand that there are limits on exemptions - which may apply to funds that you are holding when the bankruptcy is filed. Also understand that filing for bankruptcy is a very complicated process. It is wise to talk to an experienced bankruptcy attorney before deciding to take this important step. Most Arizona bankruptcy attorneys offer a free consultation about the basics of bankruptcy.

You should consult with an attorney for a review of all of your assets and the proper choice and application of exemptions. You can also review the California Code of Civil Procedure Sections 703 and 704.
