When you are in Chapter 13, after your Chapter 13 plan is confirmed by the Court, you can put your house on the market. When you find a buyer, you then have to get authorization from the Chapter 13 Trustee to sell the home. You have to file a Notice of Intent to Sell and give 21 days notice to all creditors. After that notice period expires, and nobody objects, you can get a court order that allows you to close the sale.

Not only must your bankruptcy case be reopened, but a Motion to Avoid Lien must be prepared & served and a hearing held before the bankruptcy judge Service of this Motion can be a problem for an inexperienced bankruptcy attorney - I have seen attorneys make mistake after mistake, taking nearly a year to complete what takes me about 6 weeks, simply because the process is so complicated.

First I would change banks and yes you have the right to file bankruptcy and most likely discharge or credit card debt and any other debt to the bank. Also, you have exemptions to protect certain assets like your vehicle.
