What type of bankruptcy do I qualify for?

Theodore N. Stapleton
Answered by attorney Theodore N. Stapleton (Unclaimed Profile)
Bankruptcy lawyer at Theodore N. Stapleton, P.C.
You need to call me immediately. You may qualify for a chapter 7 but only if you pass the means test which involves an income ceiling which you exceed, but you can deduct payments on secured debts like mortgages so you need to file the BK, if you qualify, before they foreclose and you lose those expenses.

Will filing bankruptcy and being discharged keep me from getting a new job in the future if the prospective employer runs a background check?

Richard Alan Alsobrook
Answered by attorney Richard Alan Alsobrook (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Alan Alsobrook
It depends on the employer.  Many employers now run credit checks on potential employees before they decide to hire the employee.  A bankruptcy can remain on your credit report for 10 years.   This is not intended to be legal advice, and is general in its nature. No attorney-client relationship exists or is formed by this information. Furthermore, this does not represent the views or opinions of LexisNexis or its affiliated companies.

What do I do if I want to file for bankruptcy but can't afford an attorney because I'm on SSDI?

I find that most people who can?t afford a bankruptcy lawyer don?t really need to go through the ordeal of bankruptcy at all. State laws called exemptions will probably completely protect you from lawsuit collections.
