Do I get to keep any of my disposable income if I file for a chapter 13 bankruptcy?

Answered by attorney William Monroe Rubendall (Unclaimed Profile)
Bankruptcy lawyer at William Rubendall Attorney at Law
In a chapter 13 you are required to include all disposable income into the payment plan. Disposable income is the excess of income minus ordinary monthly expenses. If you do not have disposable income you cannot file a chapter 13.

What can I do as a co signer if the debtor has filed for bankruptcy?

Daniel G. Shay
Answered by attorney Daniel G. Shay (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Daniel G. Shay
Unfortunately, you are liable for the debt. Your options are to pay it in full, ignore it and see what happens, settle it, or file BK. Your dads BK petition should have been listed you as a cosigner, but it doesnt make a difference.

Does a bankruptcy release her from our lease agreement?

Answered by attorney Jared Altman (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Jared Altman
If you were lawfully notified of the bankruptcy then you can check with the trustee to find out what, if anything, happened with your lease. If you weren't properly listed and the lease obligations discharged, then the lease should still be in effect.
