Can I get my car back through bankruptcy if my car has been repossessed?

John A Moffa
Answered by attorney John A Moffa (Unclaimed Profile)
Bankruptcy lawyer at Moffa & Breuer, PLLC
Probably NO. The Eleventh Circuit Court of Appeals held that in FL once the vehicle is repossessed, you lose any interest in the vehicle. If you want it back, you need to pay them or work out a deal.

Can I sell my house, keep 100% of the proceeds and move to another state with plans on purchasing another home to reside with no penalty or issues?

Sounds like you are about to get a BK discharge and that your BK trustee is taking only part of the equity in your vehicle, and not in your house. IF that's true, then its ok to sell your house and hold the proceeds. I suggest that you confer with your BK attorney!

My house bunt down and insurance paid the house can the old debtors come take my land to pay off all my old debts?

Huh? If the house was financed with a mortgage, unless the insurance proceeds paid off the entire mortgage balance, the mortgage company can still foreclose on you. Next time you ask a question, please provide more details. Your question was posted in the bankruptcy section & I don't know if you have been in a bankruptcy or not.
