Old income taxes can be discharged in bankruptcy. The rules are complicated, and you should consult an attorney. But the starting point of the analysis is a three year rule. For example, the 2010 tax return was due on April 15, 2011. Assume you timely filed the tax return. Add three years to April 15, 2014.You can file bankruptcy after that date and discharge the income taxes. I stress that the specifics of your case must be analyzed.

If you filed a chapter 7 and did not "strip" the second mortgage, you have eliminated the debt by obtaining a chapter 7 discharge, but the equity loan retains its lien. If you do not pay the bank can foreclose, though it might not bother because it would have to take over the first mortgage. You cannot sell without the consent of the equity loan because the company retains the lien.

Just having made new debt will not prevent you from filing a bankruptcy. A better issue would be how much any single transaction was and what the debt was for. For example, $1,000 at the pharmacy or $1,000 for a hotel stay.
