What is the name of the form to amend?

default-avatar
Answered by attorney Roxanne Eberle (Unclaimed Profile)
Bankruptcy lawyer at Wild Sky Law Group, PLLC
You need to amend the existing schedule listing the creditors along with the mailing matrix for the court. You will also need to send the amended schedules and the Notice of the Meeting of the Creditors to the new creditors that you list and then file a Certificate of Mailing with the court. You want to make sure to add all the creditors at one time because it will cost you $30 each time you amend the schedules.

Can my wife file for bankruptcy without using my income for the means test if we live in different households?

Susan Green Taylor
Answered by attorney Susan Green Taylor (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Susan G. Taylor
I had clients who had long been separated & had disparate incomes. His contribution to her household was noted, but their incomes were not combined for means test purposes. However, if your intent is to someday reunite, I think you would get push back from your U.S. Trustee's office.

What can I do if my bankruptcy case was dismissed?

Sean Thomas Flynn
Answered by attorney Sean Thomas Flynn (Unclaimed Profile)
Bankruptcy lawyer at The Law Offices of Sean T. Flynn, PLLC
If your bankruptcy case was dismissed it means that you no longer have the protection of the automatic stay. You have the option to re-file and you should speak with an attorney about the possibility of refilling the case. A subsequent case will have a limited automatic stay and you will need to file a motion to extend the stay in your case. At the hearing you will need to demonstrate that the new filing was done in good faith and that you are able to fund the plan.
