Don't even think about that unless you put it somewhere where the funds are safe, and you can never take them out and use for living expenses. Everyone that I know that has taken out their pension and thinks they can do better with the money lose all of it. Putting the funds into some type of irrevocable trust is the only recommendation that I would give you.  Protected from you, your creditors and anyone else who might see you as a target. As in a new spouse.

Under BACPA ( the new bankruptcy act) you have to wait 8 years after filing a chapter 7 before filing a new chapter 7, 2 years after a discharged 13 to get a discharge in another 13 and 4 years after a 7 to get a discharge in a new 13.

I agree.  It's very wrong but I have seen numerous people get lured into the same situation.  Since they haven't actually went through with a foreclosure (which is apparent from their requests that you deed the house to them or short sale it to them), you could file a chapter 13 bankruptcy and catch the house up over the next 5 years.  I also would take a hard look at the equity in the house and seriously consider whether or not it was worth trying to catch up before I put another cent into saving it.   What Texas County do you live in?  This would determine what Court had jurisdiction.   Thanks...Ken Wake
