Can I quit claim a deed if I have a judgement against me?

Answered by attorney James T Dunn (Unclaimed Profile)
Bankruptcy lawyer at James T. Dunn P.C.
body{font-family: Geneva,Arial,Helvetica,sans-serif;font-size:9pt;background-color: #ffffff;color: black;} If you deed the property to your daughter, the judgment still attaches to the property and she takes the real estate with the judgment debt. The judgment is good for 8 years from the date on entry and expires unless renewed prior to the expiration of 8 yrs. You may just want to sit tight until the time period runs. You can file a homestead exemption against the property but it doesn't protect you since there is ample equity to pay the judgment.

Is it legal to include an installment loan in a bankruptcy?

Paul D Stuber
Answered by attorney Paul D Stuber (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Paul Stuber
When you file a bankruptcy, you file the bankruptcy and not the debts. You must include all of your debts and assets in the petition of bankruptcy. The question is if it will be discharged. An installment loan could be one that has collateral, such as a car, etc. If you file bankruptcy you will most likely have to pay on that in order to keep the car. If it is just a loan, and it does not fall into the non dischargeable types then it will be discharged in bankruptcy.

Do I have any rights against creditors? How?

Answered by attorney Ronald K. Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
There are limits on how often they can call under the fair debt collection practices act. But there is no requirement that they make or accept a reasonable settlement offer, legally, they are entitled to the full amount of the debt. They can get a judgment and garnish your wages etc.
