Can I claim a property that was willed to me in my Bankruptcy record even if the owner is still alive?

Answered by attorney Thomas Anthony Vogele (Unclaimed Profile)

No. Such a gift is a mere expectancy given the facts stated in your question. You only need to disclose testamentary gifts or beneficial interests in a trust that you anticipate will become your property within 180 of filing your bankruptcy case.

Location rent

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
If you want to stay, you have to pay rent.  You will not owe the past three months, but you have no right to stay there at all.  As soon as your case is over, or before if stay relief is obtained, you will be evicted in a holdover.

Do you have to reaffirm mortgages to get refinanced?

No, this is a lie that ignorant and unqualified individuals working for your mortgage company will tell you. What the lender is really saying is that it won?t refinance you, so look somewhere else for a new loan.
