If we receive money from an insurance policy while in Chapter 13, do we have to report it to the trustee?

Answered by attorney Paul Norwood Jonas Ross (Unclaimed Profile)
Bankruptcy lawyer at Paul N. J. Ross Law, PLLC
Disclose, disclose, disclose is the mantra in bankruptcy. Always report it to the Trustee. I would do that through an amendment/supplement to Sch B and C with the information. Idaho has an exemption under many circumstances and in Idaho this would likely be exempt.

If someone has filed bankruptcy and has it dismissed, then you do a reaffirmation on your home loan, does the dismissal invalidate your reaffirmation?

Bankruptcy lawyer at A Fresh Start
A reaffirmation is unnecessary when a bankruptcy is dismissed because the reaffirmation only supersedes the bankruptcy discharge. A dismissed bankruptcy is, by definition, one without a discharge.

If I file for bankruptcy then get married to her, would I be liable for the debt again?

Answered by attorney Rex K. Daines
Bankruptcy lawyer at OlsenDaines
No, you will not be liable for the debt if you later remarry. You might also consider getting married and then filing a joint chapter 13. Based on the date of her prior chapter 7, she might qualify to get a discharge in a chapter 13.
