If I default on my credit cards, can they take my house?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
In Illinois, a judgment is enforceable against a home, assuming that the home is titled solely in the name of the judgment debtor. The creditor has to pay off any mortgages on the house and also has to pay the consumer the homestead exemption. For this reason, actual sales of homes to satisfy judgments on unsecured debt are rare. A more common collection strategy is simply to record the lien on the house; it can remain there for over 20 years and would have to be satisfied upon any sale of the property.

Is it lawful for these two liens to be placed on my home?

Answered by attorney James T Weiner (Unclaimed Profile)
Bankruptcy lawyer at James T. Weiner, P.C.
If you clearly indicate to the loan officer that the loan is intended to also pay off the SBA liens (and it does) then you should not have any problem. Its the title company's problem to get a payoff letter

How do I stop wage garnishments?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
Good news: Filing Bankruptcy stops wage garnishments. Bad news: student loan debt is generally nondischargeable, absent a very difficult to make showing on "undue hardship." This showing needs to be made in an Adversary Proceeding in a bankruptcy case. Bottom line: It is time to talk to a very good bankruptcy attorney.
