Are you required to pay a debt that dropped off your credit report and has been passed from different collection companies over the years?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
Unless you are dealing with a mortgage, the debt is past the statute of limitations in Illinois and there is no reason to pay it if you do not wish to do so. A collection agency that seeks payment without disclosure of the time-barred nature of the debt may be violating the law.

Can my ex husband be sued for my credit card debt?

Charles J Schneider
Answered by attorney Charles J Schneider (Unclaimed Profile)
Bankruptcy lawyer at Charles J. Schneider, P.C.
Your husband can only be successfully sued for a debt he owes. His liability arises from signing the contract to repay the creditor not out of a marital relationship. So let them sue and he goes to court and challenges them to present something he signed to make him liable. If they cannot he wins.

Do I have a right to an itemized bill request from the hospital?

Nicholas Carlos Best
Answered by attorney Nicholas Carlos Best (Unclaimed Profile)
Bankruptcy lawyer at Detroit Lawyers, PLLC
Assuming your 2012 bankruptcy was a chapter 7 where there wasn't any distribution to any secured creditors, this bill would have wiped out with that bankruptcy. Either the collection agency didn't get notice because you didn't list them or it's a different creditor that bought the debt since then. Either way, there's nothing for them to collect since they didn't miss out on anything from your bankruptcy. Send them a copy of your discharge if they want and tell them that if they continue to contact you that they'll be in violation of the FDCPA and you'll seek damages. Asking them to verify and validate never hurts but you probably don't even need to mess around with that. Shoot me an email if you have any questions.
