Can the loan company call in the loan and make the whole loan due immediately?

Sally J Elkington
Answered by attorney Sally J Elkington (Unclaimed Profile)
Bankruptcy lawyer at Elkington Law
I can't see any reason that your loan can be called. You are, in fact, reaffirming terms of that loan, which binds you AND THE LENDER. Stay current and keep your vehicle insurance up and you should be fine.

Can we ask to have the case dismissed and start over with new attorney?

Answered by attorney Dustin Douglass Deissner
Bankruptcy lawyer at Deissner Law Office, P.C.
You can change attorneys and keep the bankruptcy going. You can also dismiss but it will cost more and there are other possible problems with dismissing and refiling, you should find a new attorney and ask him/her about it.

What can I do if trustee is taking over my lawsuit?

default-avatar
Answered by attorney Ronald K. Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
You don't have any way to fight having the trustee take over the lawsuit. However, the trustee has a fiduciary duty to make certain that any settlement is fair and reasonable. The other thing you should consider is changing your exemptions to use the maximum exempt for this lawsuit.
