How do I proceed to receive full payment as my shipment arrived post-bankruptcy filing?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
First of all, you would benefit from retaining a skilled bankruptcy lawyer. You would likely have had strong reclamation rights if you had demanded reclamation during the first 10 days after your customer filed its petition. But if you did make your demand in that period then your lawyer might still be able to move the Court for reclamation. Failing that you probably would have an administrative claim to be paid in full. Again... a good lawyer is what you need.

Do I need to pay the shipping back on a product that does not work to get my money back?

The product has to go back, right? If they're willing to pay customer service, that's great. If you're doing a credit card charge back, then you do need to pay to send it back, with tracking and delivery confirmation. Nobody gets to keep the product and get their money back, right?

If I got a subpoena in the mail, can I file bankruptcy without implicating my spouse?

Mark Stuart Cherry
Answered by attorney Mark Stuart Cherry (Unclaimed Profile)
Bankruptcy lawyer at Mark S. Cherry, Attorney at Law, PC
Your present spouse cannot be liable for premarital debts of yours unless the spouse consented, in writing. Whether you would be able to file bankruptcy requires a consultation with an attorney to determine whether the debt is dischargeable, which Chapter of Bankruptcy, 7, 11, or 13 would be appropriate. There are issues related to assets, liabilities, and income that may affect your ability to discharge the debt. Your marriage may affect the household income calculations in a bankruptcy situation.
