Could I include my credit card debt in bankruptcy?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You have two crucial questions was it okay to use the credit card that was taken out by someone else? If you became legally responsible for paying this card, your continued use of the card was fully legal. An easy way to find out would be by checking your credit report. Recent use of credit just before filing bankruptcy can be a problem, so if you have not stopped using these cards, now is the time to stop! As to your marriage, being married to a person who is financially stable may put you in the position of being ineligible to file bankruptcy and requiring your spouse's income to pay for your debts. If you make the decision to file bankruptcy, you should file before you get married rather than afterwards.

Can I file chapter 13 bankruptcy with my daughter for a car I cosigned for her that she let go back and not affect my husband?

Someone can file joint bankruptcy with their spouse, but not with their parents or their child. You or your daughter could file a Chapter 7 or Chapter 13 (depending on what you can qualify to do), however, it might be less expensive to look at settling this debt if it is the only debt you are concerned about.

I'm a minority owner in an LLC (15%). How can I leave the LLC (transfer my equity) so that creditors will not go after my personal assets?

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
Without the commingling, leaving before bankruptcy would leave you likely totally clear.  The commingling is a problem.  Bankruptcy is not a good idea if there has been commingling.  It makes veil piercing easier, not harder.  Get better legal advice.
