What you need is to hire an experienced bankruptcy attorney to represent you. You may qualify for a chapter 7. You can learn about it in a pamphlet which is at my website. You can also do the online means test calculator to find out if you can file that chapter. It would be preferred in order to get rid of all of your debt except the mortgage and car loans. And you may not want to reaffirm the mortgage, depending upon a number of factors. Do not think that a bankruptcy petition preparer can do anything near what an attorney can do. The filing fee for chapter 7 is now $306. A reasonable attorney fee is from $1000 to $1500 for a chapter 7. You must first contact a consumer credit counselling agency which is approved by the bankruptcy court and get a certificate from them.

The only way to have his name removed from the lease would be if the landlord agreed to same, which is unlikely. As such he will remain responsible for the rent and any damage caused to the trailer while the lease is in effect. However, your son does have a legal right to live in the trailer as he is a signer on the lease and without a court order she cannot keep him out of the trailer. He has an equal right to possession of the trailer unless the court orders otherwise.
