If we file for bankruptcy and leave the country, do I have to repay the loan? How does the repayment work?

Answered by attorney Dustin Douglass Deissner
Bankruptcy lawyer at Deissner Law Office, P.C.
The debt will not go away unless you declare Bankruptcy. Of course the creditor is unlikely to pursue you in India. The Bankruptcy will remain on your credit profile in the US for 7 years or more, but you're hardly the first person to have a bankruptcy on your record. If the debt is nondischargeable (e.g. student loans) then it will essentially never go away. However if you return it will just be another old debt, hard to say if anyone will seek to enforce it. Your wife might be affected since this is a community property state. Your children would see no effect.

What can happen if I have been approved to rent apartment, I file bankruptcy, and I have a lease vehicle?

If you continue to make your rent payments, are current on your lease and rent, reaffirm the lease agreement, you can continue to maintain both the apartment and the vehicle.

Can I keep both my vehicles if I file chapter 7? I own one and am paying on the other.

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
If you have no equity in the one vehicle because of the loan against it, in order to keep it, you will just have to make sure you pay for it & if required, sign an additional agreement with the lender. As to keeping the vehicle that is paid form,as long as the value of the vehicle is below the amount allowed as an exemption in the state where you have lived during the past two years, you can keep it. State exemptions vary widely in this regard, in Nevada, the vehicle exemption amount is $15,000. By the way, you do have other assets..like the clothes on your back! Bankruptcy law requires you to list everything you own, even things you consider "small potatoes."
