Will a slight increase in pay affect my Chapter 7 Bankruptcy?

Your income for the 6 months before filing and your current income play into the question of "do you qualify for a chapter 7". Since you are represented by counsel they are required to answer your questions. If they don't then go to an attorney who will treat you with more respect.

Can I file a bankruptcy only on the home equity line of credit?

No, but you may be able to get rid of the second mortgage, depending on the value of house and the debt owed to the first lender. This is called a chapter 13. A chapter 13 bankruptcy is a very complicated process. It is wise to talk to an experienced bankruptcy attorney before deciding to take this important step. Most Arizona bankruptcy attorneys offer a free consultation about the basics of bankruptcy.

What can I do to stop the motion to remove the stay?

Question: What can I do to stop the motion to remove the stay? Question Detail: I want to keep my car. I'm in chapter 7 bankruptcy. It stayed but dealership filed a motion to remove the stay. *- the dealership most likely wants to have the automatic stay lifted so they can proceed to reclaim the car if you're behind; you might be better filing a motion to convert to a Chapter 13 if you have the disposable monthly income to support a confirmable plan. You should consult a lawyer about this ASAP - you MIGHT be able to "cram down" the value of the vehicle (get the loan balance reduced if certain conditions can be met) AND pay the arrearage through the plan*
