Can I file Chapter 7 bankruptcy after filing Chapter 13 bankruptcy?

Answered by attorney Curtis Lee Chronister (Unclaimed Profile)
Bankruptcy lawyer at Chronister Law Firm, LLC
Yes, you can file for Chapter 13 and you are eligible to receive a Chapter 13 discharge at the end of your case. Go see a solo practitioner or small firm with a good reputation. Stay away from the consumer mill type firms that boast about the number of cases they have filed.

What can we do about spousal support?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
It is true that his filing a Chapter 7 bankruptcy won't let you proceed with collection until the case has been discharged, but that is only going to be for a few months. You could apply to have the bankruptcy protection removed, but doing so could be more costly than in would be beneficial. The bankruptcy will not eliminate the liability to pay the spousal support or reduce or eliminate the delinquent amount owed on this debt.

Will I lose my house if my ex is going bankrupt?

default-avatar
Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
No. You will not lose the house. At least, you will not lose it because of the bankruptcy. You have the right to continue making your mortgage payments. As long as the payments are current (that is, you are not in default), then the mortgage company cannot take any other action.
