Representative Cases & TransactionsCasesIN THE INTEREST OF J.B. et al, 127 York Legal Record 60 (2013)
- Judge. Ruled that the lifetime Sexual Offender Registration
Notification Act (SORNA) for juvenile offenders is unconstitutional retroactively
prospectively based upon recent United States Supreme Court cases namely Roper v. Simmons, Graham v. Florida,
Miller v. Alabama, which highlight the essential constitutional distinctions between treatment of juvenile offenders
adults within the criminal justice system. The opinion rejects the premise that that the lifetime sexual offender registration is an incidental non-punitive collateral consequence of an adjudication of delinquency for a sexual offense
, concludes that the lifetime quarterly
interim sexual offender update requirements coupled with substantial felony criminal sanctions with m
atory sentences automatically imposed on adjudicated youth is clearly punitive. One of flaws found with the legislation is that it indiscriminately imposes the lifetime registration requirement on all youthful offenders without a separate hearing when it is scientifically established that offending youth have a low recidivism rate.
