    Representative Matters: Summary Judgment Granted Rendering Deed Restriction Unenforceable

    Brian E. Tims recently secured summary judgment on behalf of a residential l
    owner seeking to invalidate a deed restriction prohibiting further subdivision. The Halloran & Sage attorneys successfully argued before the Superior Court in Stamford that the Westport Zoning Board of Appeals (ZBA) illegally required the imposition of such restriction in 1993. The Superior Court agreed
    reasoned that the ZBA exceeded its authority,
    did so in such a manner that permitted a challenge of the deed restriction over 20 years after its recording on the l
    records. Accordingly, the Superior Court declared the subject deed restriction void, illegal,
    of no effect.

    Ann Catino Obtain Favorable Decision From Westport Planning
    Zoning Commission
    Ann Catino recently obtained a favorable decision from the Westport Planning
    Zoning Commission, which voted to approve construction of a new 102, 000 square foot Westport Weston Family Y on a 32 acre parcel adjacent to the Merritt Parkway
    bordered by the Saugatuck River. Eric Bernheim also assisted in this matter.
    This final decision followed approvals from various town bodies
    the Connecticut DEP, as well as many hours of hearings
    deliberations by the Planning
    Zoning Commission. This was the longest application in the history the Commission.

The Martindale-Hubbell Peer Review Ratings process is the gold standard due to its objectivity and comprehensiveness. Lawyers solicited for peer reviews include both those selected by the attorney being reviewed and lawyers independently selected by Martindale-Hubbell. All reviewers are verified as attorneys through Martindale-Hubbell’s extensive attorney database. Only attorneys practicing at least three years and receiving a sufficient number of reviews from non-affiliated attorneys are eligible to receive a Rating.

What are the different Martindale-Hubbell Peer Review Ratings?*

• AV Preeminent®: The highest peer rating standard. This rating signifies that a large number of the lawyer’s peers rank him or her at the highest level of professional excellence for their legal knowledge, communication skills and ethical standards.
