    Representative Matters: Summary Judgment Obtained in Notice Policy Exclusion Matter
    Kevin J. Riexinger successfully defended a national insurance company in an underinsured motorist lawsuit, Shurika Rosado, et al. v. Felix Cabrera, et al., brought by three occupants of a vehicle that had been rear-ended on Park Avenue in Bridgeport. Plaintiffs' counsel failed to notify the insurer within three years following the date of the accident that his clients might have a claim for underinsured motorist benefits. Notice within that three-year time period is specifically called for by both C.G.S. 38a-336(g)
    the applicable insurance policy. Halloran & Sage's motion for summary judgment cited an Appellate Court case holding that the policy exclusion should be upheld when the exclusion is drafted in congruence with the statute,
    when there is no question that notice was not timely provided. Judge Dale W. Radcliffe granted summary judgment in favor of the insurance company from the bench.
    H & S Obtains Defendant's Verdict in Hotel Guest Accident
    Halloran & Sage obtained a defendant's verdict in a matter in which an inn was accused of allowing a dangerous condition to exist in its parking lot causing a guest to injure his ankle. The plaintiff alleged that he fractured his right ankle when stepping or falling off a retention wall in the parking lot of the inn. Evidence presented included information regarding the lighting of the parking lot, shrubbery lining the wall, safe alternative means of travel, intoxication by the plaintiff, photos
    statements. The jury concluded that plaintiff did not meet his burden of proof that the inn's parking lot retention wall constituted a dangerous
    defective condition
    found that reasonable care
    common sense were not exhibited by the plaintiff. A defendant's verdict was obtained.
